Slip and fall accidents: Injuries may result from falls because of holes in parking lots and cracked sidewalks. Generally, a person may make a claim for negligence if the property owner's failure to use reasonable care in maintaining his/her property causes an injury. However, cases involving parking lot and sidewalk accidents may be complicated, the defect or irregularity on the property must be significant enough that the owner should have knowledge of its hazard. If the defect is noticeable enough, it may be considered an open and obvious danger to everyone. In New York, a claim can only be made if the owner of the property has notice of the defect by way of actual notice or if the condition has existed for such a period of time that the owner should have, with due diligence, discovered the defect. Liability will also attach to the owner if he/she has created the defect.
